The following Terms and Conditions are deemed as read, understood, agreed upon and effective once the enrolment has been processed.
You must provide truthful, accurate, and current information about yourself during the registration process and maintain and update your data so that it remains at all times accurate, current and complete. The truthfulness, and accuracy of such information, is at your sole responsibility.
Brain Play fees are due in advance. We have a number of payment schemes available, for information on these contact our administration executive via email - email@example.com.
Paid fees are non-refundable and are forfeited should a student voluntarily discontinue enrolment part way through a course. Cases of medical or other emergencies where pre-lesson notice is impossible to give, please call us when you can and we will do what we can to accommodate your situation, at our discretion. We will endeavour to transfer your payment but cannot offer a refund.
Students under 16
Parents or guardians of students under the age of 16 must arrange transport facilities for students. It shall be the sole responsibility of the parent or guardian to ensure the student has arrived safely.
At no time will Brain Play be responsible for the student before arriving or after leaving their scheduled class session.
All enrolment forms must be signed/electronically agreed to by the parent or guardian in order for them to be processed.
Cancellation or non-attendance
Cancellation or non-attendance due to illness or for personal or professional reasons does not entitle the customer to a refund. In the event of after-school classes, a makeup session will be offered. In terms of holiday programmes, a makeup session can be offered, but only given that the same course is scheduled for a second date, and has space for an extra enrolment. In such an event of non attendance not covered above, the centre will consider all the relevant circumstances and proceed in a fair manner. If you know that your child will not be able to make their scheduled class day, then please inform us beforehand.
If a student is leaving Brain Play, either temporarily or indefinitely, notice is required. Paid fee is non-refundable and is forfeited should a student discontinue attendance. In cases of medical or other emergencies where notice is impossible to give, please call us and we will do what we can to accommodate your situation. An exit feedback survey may be administered; we would appreciate your participation.
The centre reserves the right to cancel or amend courses, change course dates and substitute educators at any time. In the event of a course cancellation, transferal of a lesson or a refund will be provided.
Rescheduling of a class by the centre
For any particular class postponement for reasons for which the centre is responsible, the centre will ensure that the class is rescheduled or where this is not possible, transferal will be arranged. However, the centre will not, be liable for any losses including, but not limited to, travel and accommodation expenses arising as a consequence of any modification of courses.
Use of the computer lab and equipment
The course fee is inclusive of the use of a computer lab, course materials/resources and online resources.
Rules and regulations around handling and using equipment will always be discussed with students on their first lesson. Reminders will also be issued when dealing with specific equipment including, but not limited to robots, electronics kits, and laptops.
Students are prohibited from downloading, uploading or installing any software without consent of Brain Play staff, and may not change any computer set-ups, including passwords.
Authorization is required before students can use any external storage devices such as USBs.
No mobile phones, gaming consoles or any similar electronic equipment, unless with the consent of the staff, are to be used during class.
Eating and drinking is prohibited in the computer lab as is smoking on any premise.
Students are to handle all equipment at Brain Play with care and respect, and are liable for any damage they cause. Brain Play will notify parents in the event of damage being caused and payment/replacement will be expected and required upon agreement to these terms and conditions. Contact around damages may be delayed as we will always set aside time to attempt to fix damages in house before determining whether we need to seek outside repairs, and also compensation from the student at fault.
For students under age 16 liability is transferred to the parent / guardian of the student.
Students are expected to conduct themselves in a professional manner. If a student becomes persistently disruptive or disrespectful toward other students, staff or equipment, Brain Play reserves the right to give a verbal warning of potential withdrawal from the current session.
If a student is dismissed for misconduct, no refund will be given.
Students enrolled Brain Play will have access to online course information, academic software and electronic learning resources. Students are expected to use the Internet for the intended purpose, which includes learning and enhancing technological skills. Acceptable use includes accessing trusted programs, accessing content that supports the educational objectives (with consent from staff) and communication with supervisors through allocated platforms.
Unacceptable use of the Internet will not be tolerated; use of devices and the Internet is a privilege not a right. Downloading, uploading, installing or using software programs or files without permission from a supervisor is a prohibited action and the student is liable for any damage caused as a result. General Internet usage that does not support the educational objectives of Brain Play is also deemed unacceptable. Misuse will be dealt with in a manner that Brain Play deems suitable, including but not limited to; informing parents of misconduct or dismissing the student from the class. Brain Play’s actions will be executed at the company’s discretion and may not be challenged.
Brain Play and its employees accept no responsibility for any loss of or damage to personal belongings of students, or for any personal injury to or death of a student occurring on the centre premise, whether by fire, theft, evacuation or by any force majeure event. Nor is Brain Play or, its employees liable for damages for cessation of operation and resulting cancellation of courses due to an event outside the Centre’s control. Students are at all times liable for any damage caused to Brain Play’s premise and property, or the premise and property being used by Brain Play at the time e.g. P.E. gear, or a school hall.
Brain Play reserves the right and retains copyright to all promotional photographs, which may be taken of students on its premises. Prior permission will be obtained from the student and parents or guardians before taking photographs, and the student, parents and guardians have the right not to be photographed. No personal details of students will be passed to third parties, except the appropriate authorities, without prior consent.
These terms and conditions will be governed by and are construed in accordance with New Zealand Law, and are subject to the exclusive jurisdiction of the Courts of New Zealand. These terms and conditions are subject to change without notice, at our sole discretion. We will notify customers of amendments to these terms and conditions by posting them to our website.
